How does it work to give a leased car to CarMax?

CarMax’s site says they also buy leased cars. My car has a value on KBB of about $8000. I have less than $4000 left on my lease (1 Year)

You have $4000 on the lease PLUS the residual. In order to buy a leased car, you have to pay the remaining payments plus residual. Also, check your lease for any early termination fess.

IF Carmax buys it they will pay to the lease company, not you. But be prepared, you rarely get a buyout on a lease - the car’s value is usually well below the payoff

Business personal property tax for leased business equipment and software?

Who is obligated to pay business personal property tax if we leased the equipment, us or leasing co.? How about computer software? Is software treated same way as other business equipment (copier, computer etc), or it has different rules in terms of business property tax.

That depends entirely upon local laws and the terms of your lease. Most commercial leases are written such that the lessee pays all taxes and unless local law bars that practice that contract stipulation would stand up in court.

As to computer software, most localities only tax tangible personal property so software GENERALLY isn’t taxed. However that is a local issue as well, subject to the interpretation of local laws and the terms of the lease.

Should I sue my dentist office?

Depending on how much boneloss you have, removing the tooth/teeth may be the only option aside from major Periodontal work. Periodontist charge several hundreds of dollars just to get the gums in order, not including any bone grafting that could help maintain any teeth that have an “ify” prognosis.
It sounds like there is more of a miscommunication between you and your dentist and you should ask for the treatment plan IN WRITING along with what work has already been completed. Also a statement what work has been submitted to your insurance and any payments you have made and what the insurance co has made. Have the dental office give you a detailed break down explanation of the work done, work to do,the whole 9 yards!
Going in there with both barrels loaded is not getting you anywhere and it sounds as if this dentist has stopped trying to reason with you.
A temporary bridge is placed in the interim while a permanent bridge is being fabricated, but, sometimes the permanent bridge is put on hold while the dentist waits for the gums to heal and shrink up after extractions. If you had 1 or 2 teeth taken out, the bridge would in all likelihood span at least 4-6 teeth especially if they are concerned about a perio problem in your future, seeing that you have lost 1-2 teeth to a perio condition already.
It also means if you do get this bridge you need to be a FASTIDIOUS brusher and continue seeing a dentist on a regular basis to make sure that bridge has a longer lifespan.
Xrays will are taken prior to treatment because the insurance co. require this and because it is a record of what your dental history was prior to any treatment. This in all likelihood will work in favor of your dentist if you decide to take her to court because she can show your previous dental condition. Having a space were teeth were doesn’t give you any proof to sue.(Also if your teeth were creating more space before any treatment, that is a huge indicator you have had perio problems and boneloss before this dentist got started, she may have tried to salvage the other tooth for your sake and found out after all her efforts it could not be done)
Get your records, copies of xrays (including the before the teeth were exrtracted) and get a second opinion.
If the second opinon concurs with you 1st dentist, then it is more thanlikely just a misunderstanding not a fraudulent claim.

Is My Lease Still Valid?

I signed a retail lease almost 4 months ago for a space for my restaurant. The landlord has not signed it yet nor have they asked for a security deposit. They won’t tell me when the space will be ready or anything. They keep telling me that they are working on getting the building permits, architectural drawings, etc. I’m need to move ASAP and am thinking to look elsewhere. Is this lease still binding, even though it was 4 months ago and nobody but myself signed it? No security deposit or anything. Thank you for your time.

You signed an agreement. Whether you now have a duty to perform its terms depends on whether the landlord has performed his end of the agreement. Nobody can give you an answer without knowing what exactly you agreed to.

Improvements are depreciated on line item over 39 years. With straight line depreciation you are allowed to depreciate the cost of the improvement over 39 years from the finalization of the improvement. So you may have purchase the property 10 years ago, a new roof 5 years ago and added an elevator last year. Each “line item” is depreciated from it’s finalization date be it acquisition or improvement each is treated individually.

Any way to quell the invasion of trespassing pool-goers?

We live near the UCSD campus in a condo complex. Every weekend, a family that does not live there comes and takes over the pool the entire day and will not budge. Seriously, they number about 2 dozen people or more..they leave trash everywhere when they are done, and rearrange pool furniture and there is food in the pool. They are very noisy and rude and if you confront them, they get nasty with you and act like you are the one with the problem. It used to be a nice relaxing experience but now there is no way to enjoy it at all. What is worse, they climb the gates and then pick the locks from the inside and wedge paper inside the locks to keep it open for more family to come in. I am amazed that the office and HOA will do nothing, not even hire a security guard! For the friggin high price of housing, this is beyond annoying! My biggest worry is the propped open gates. As a parent, I am scared that a young child will wander in and drown.
Any ideas??

The pool has to be regulated by the Management, but if I’m not mistaken a condominium community has to have a permit to have a pool. To get the permit, they have to follow the guidelines set up by the Housing Authority <--- that's a BIG leap, I'm not sure who governs it but that made sense to me.

Anyway, in short -- the gate issue:: if it poses a threat to public safety, and it clearly DOES, someone needs to remedy it or the Owner of the complex can/will be sued for negligence if someone drowns. They don't want that, so if you take digital photos of the situation and provide them with the pics and a short letter about what's happening, I bet they'll do something.

SOMEtimes, saying "if I need to, I'll speak to my attorney about this issue since, after all, I am a PAYING tenant and the trespassers aren't" will get their butts in gear a little quicker.

Rental Contract/Agreement - going on vacation and want to rent apartment?

I’m going on vacation for 10 days and want to rent my apartment to a complete stranger. I need a contract/agreement sample but don’t know what it’s considered. It’s not a sublet, and is more of a short term thing. Additionally, I know my landlord doesn’t need to be involved because we asked if we could do this and he said sure, and that he didn’t need to sign anything. Please direct me to a place I might be able to find such agreement. What is it called? A short term lease? Thanks

A couple of caveats -

Get a good deposit (in case of damage like a broken window, coolaid on the carpet, etc.)

Hide or remove any candles. Don’t need the place burning down while you’re gone.

Remove anything of real value that you can easily replace if its broken or stolen. Once had a vacation rental that had decorative pillows worth $150 each. Rental tenant was caught on video taking the expensive pillows and replacing them with $10 K mart pillows.

Be sure to change the locks when you get back OR put a codable key pad on the front door with a code you can easily change. You don’t need extra keys floating around to your house.

Make sure its clear about the condition of the property before and after they leave. Who will clean it? What is the consequence if they don’t? What if they damage something? Make sure you have accurate ID and credit info on them. We had a client pay with a check (which bounced) and another who used a phony credit card.

If you secured the lease with your Personal assets, you are likely to be sued by your landlord. If you secured the lease with your Business assets, your Business will likely be sued. Thus either way it might be a good idea to speak to a lawyer. Look in the yellow pages for Real Estate Lawyers. My guess is that, like you, your landlord would just assume not having to pay a lawyer anything if they can avoid it so I highly suggest you speak to the landlord first to explain your situation (like if you are going out of business).

How do I deal with a general contractor that isn’t doing his job?

Land Rover LR3 - elligible for Ford X Plan?

I heard that with the Ford X Plan, one get get an LR3 for 4% over invoice. Is this true? I want to lease one but I don’t want to pay more than $500/mo. Think this is possible? Thanks in advance for your help! I’ve been in the market for MONTHS now and could use all the advice I can get!

Yes, that is correct (Land Rover X-plan price is 4% over invoice), but keep in mind that X-Plan dealer participation is not mandatory, so you should call any dealership to make sure they participate before heading down there. I don’t know how this discount would translate to potential lease offers. I wouldn’t recommend buying based strictly on the monthly payment — makes it too easy for the dealer to obscure the true cost of the vehicle (i.e. they can add extras and bump up the interest rate without it being immediately apparent).

Also, while I do think Land Rovers are nice cars, they are consistently ranked near the bottom of Consumer Reports’ reliability ratings and tend to be rather expensive for what they offer, even amongst luxury brands. I would think twice about taking the plunge.

What are the chances that I will get this apartment?

I filled out the applications for my husband and I to get this super great apartment. Our application was first and we payed the fee to hold it while the owner does the credit check. The thing is my husband and I lived in the same apartment complex different buildings while we were in college. We had to move before the lease was up (we both signed for the year), but we settled and payed a rather large sum. Would that effect our credit or the chances of getting the apartment?

Unless your credit is pretty bad (say, a FICO below 600), you’ll probably be just fine. It’s pretty nerve-wracking, though, isn’t it?

Breaking a lease early would NOT affect your credit score, provided that you and your previous landlord agreed to the terms. (It sounds like you did.)

You’ve got commas separating things that ought not be treated in that manner.

1. I am a 15 year old, : get rid of the comma because you’re not just a 15 year old, you’re a 15 year old sophomore.

2. Kill the words “Since I can remember…” Capitalize The (thought of working alongside…..etc. says it all in that it’s been your lifelong dream. How well you remember it is irrelevant.

3. You’re closing with a question. Add your question mark (?)

The post script is not allowed. If the content matters, it should be important enough to be part of the body of your letter. I disagree on your including it, by the way. It adds nothing to the note. It’s obvious you want something and are asking for it openly. That’s adult of you. In a way, you’re saying you want something. You don’t need to say you REALLY want something. We trust your sincerity and intent.

What brochures are you requesting? You need to be specific or run the risk of receiving no response.

Otherwise, I think you’ve done decent job of making it clear you know what you want and you’re trying to find your way to that place. I’d love to hear back from you via email if you’re rewarded with a good response!

Buying a new van and…..?

Would like to know the pros and cons of all the different purchse plans?

Hmm, there’s a lot of “if’s and but’s” here.

Is there any particular reason why you would want to own the van at the end of the payments? A 3 year old van will be pretty much knackered.

Can’t talk specifically about hire purchase as I’ve always avoided it. Lease purchase will have restricted mileage and more than likely a balloon payment at the end of the agreement. Contract hire is a bit of both.

If it was me, I’d go to my local Norflex hire company (just google it). You hire the van from them, they service it, tax it, change the tyres on it. All you have to do is put diesel and oil in it and insure it. If you’re looking at a van for a long time, you’ll get very cheap rates. You can even get it signwritten by them as part of the deal. Company I worked for hired XLWB Sprinters and paid less than £100 p/w I guess you’ll be self employed? If you are, a hired van is 100% tax deductable and you get a new van every 12 to 18 months.
